The United States appeals from so much of the April 7, 2003 final judgment of the United States District Court for the District of Connecticut (Alfred v. Covello, Judge) as sentenced John Canova to a one-year term of probation after a jury trial at which defendant was found guilty of various substantive and conspiratorial crimes relating to his involvement in a multi-million-dollar Medicare fraud. The government asserts that the district court erred (1) in refusing to apply loss and obstruction enhancements to the calculation of Canovas Sentencing Guidelines, and (2) in granting a downward departure based on defendants history of public service and good works. Canova defends the district courts sentencing rulings but cross-appeals from its denial of his motion for a new trial.
