The action arose from statements allegedly made by Dr. Casso concerning Othal Brand, plaintiff below, during an election in which the parties were opposing candidates for the office of Mayor of the City of McAllen, Texas. Mayor Brand, the incumbent, alleged in his petition that Dr. Casso made several false statements about him during the 1981 campaign concerning his term as mayor.
